Bounced cheque - advice pls!

First I'd like to say Hi and second I'd appreciate some help on the below....

I have a Ltd company which accepted a cheque for goods totalling £425. A copy of the cheque (not the original) was sent back by my bank stating the cheque was stopped as it was stolen. The original cheque has been retained by the bank for investigation.

The cheque is a company cheque. I have contacted the company who say they made the bank aware of the theft of the chequebook and it was not their problem.

How can I get this money back?!

Were did you give the goods out to? The same company and same address? If they are at an address and your terms say the goods still belong to you until full payment is received you have the right to lift the goods as they are stolen. If you know the person that took the goods from you and address maybe contact them.

Them reporting a chequebook stolen and not paying you are two separate matters.

1. they had a cheque book stolen

2. They have not paid you.

Here is the thing, by law you could get the court to find out if they wrote any more cheques after the one they wrote you, but from the same chequebook. It could be a little embarrassing for them if it transpires they have and the only cheque they stopped for 'stolen' reasons was yours.

I would tell them
pay up, return the items, or go to court and face the police for obtaining a pecuniary advantage by deception.
