Thanks Karl a really useful (and timely) summary! I think with the challenges employers face with the new Living Wage, Pensions Auto Enrolment and the case law around the calculation of holiday pay it is quite a challenging landscape for employers at the moment.
Hi Geoff
I also asked this questions for my Ltd Company where my partner is a Director of the business but does not have a contract of employment. My understanding is that the answer you have given is correct. You can always give the Pensions Regulator a call to double check. Kind regards Sarah
Welcome to the site!
Just a couple of questions first Do you have a contract? and if so what are the notification arrangements for sickness as this can impact eligibility for SSP. Does the employee earn more than £112 per week?
The employee can self-certificate for the first 7 days of...
Hi Simon
Many providers will offer off the shelf options for disciplinary and grievance procedures, ACAS is a good source of info for employers. Although these will need tailoring to the specifics of your business e.g. something which may be Gross Misconduct for your business may not be for...

Hello everyone

I have just taken on my first employee and I know taking on staff can be really daunting and a bit of a minefield for employers.
I have...
Hi Sam363636
It sounds like you are currently unhappy in your role. Have you tried talking to your employer about this? Not being told about your promotion application outcome is not great but this would not constitute a breach of the implied term of mutual trust and confidence in itself. If...
Hi BCreative it sounds like you have handled this as sensitively as you can given the circumstances. If the employee does not feel ready to return to work then this will either be an absence or because they are taking annual leave.
As you probably know they can self-cert for the first 7 days...
I agree with OldWelshGuy if his GP has said he is unfit for work I would want evidence from either an Occ Health Assessment or a GP signing him as fit for work. Your insurers may have a problem if he subsequently as an accident at work especially if related to a pre existing condition. I would...
Hi James
I would suggest that you make the bonus scheme discretionary. You could try the following (please note that this assumes there is a probationary period within the contract):
Following successful completion of your probationary period you will be entitled to participate in the...
Thanks Sandra I was not sure of the normal working day and I agree hours always work best when trying to explain holiday entitlement for part timers. Yes that should be 19.25 days for the full time pro rata I will blame the pesky Iphone for the typo. I hope this has helped Cooky.
Oooops yes sorry about that missed that bit. Yes I think it does Statutory only holidays. So I've calculated it as 29.7 days as follows:
3/5 * 33 = 19.8/12 = 1.65 days for August.
4/5 * 33 = 26.4/12*4 = 8.8 days for Sept - end Dec
33/12*7 = 18.25 days for Jan - end July = 29.7 days total.
Hi
If you go to the gov.uk website there is a holiday calculation tool. Sorry I can't post the link apparently you can only do this after 30 posts!
You can then calculate the holiday entitlement by splitting the periods into three separate blocks and adding them together e.g. calculate the...
