Council pursuing director for Ltd Co rates bill

Hi guys,

A friend of mine had a company that was dissolved on 1st March. A few months business rates were owed to the county council. He was the only director and 100% shareholder.

The lease and rates bill were in the limited companies name. The council have threatened to pursue him personally for rates from 1st March onwards, he left the property about a month later.

They can't actually do that can they?
 
The company ceased to exist, died, got sucked into a wormhole and was wiped off the face of the earth on 1st March.


What you have after the 1st March is an individual occupant that just happened to be a director of the company that was the former occupier.


I think that your friend is personally liable for the time he was occupying after 1st March.

    Has notice of dissolution been provided to the local authority? I ask this becasue you say, the original liabilities were in the name of the company.

    But the council is not pursuing a liability that accrued while the limited company existed. they are pursing an individual for liabilities that accrued after the limited company was dissolved. The limited company has nothing to do with the liabilities accrued after 1 March.
