Sun Holidays-Unusual Terms?

    Hi Just a cheeky query, Online booking for the Sun holidays offers. When you have selected your holiday and filled in the payment section, the final part asked you to tick a box confirming that " you confirm that you accept the terms of the holiday provider, which will be sent with the booking confirmation documents, " So they expect people to accept without being able see the terms. Further more once booking paid for and bought, there can be no refunds or amendments.

    Is this actually legal under e-commerce laws (or any other?)

    That's the one Chris. Clause 4 is relevant. BUT my reaction was caused by being unable to see the holiday site owners T&C before I had to tick a box confirming that I agreed to them! No tick the box, no ordering!

    No. And not just e-commerce. Terms introduced after formation of the contract, are not part of the contract, whether booking online, in person, by post, by telephone, or driving into a car park (Thornton v Shoe Lane Parking Ltd [1970]), one of the cases which first established the principle).

    I am always surprised by the number and wide experienced expert people on this forum who offer their help,, a sign that not all the news we hear is bad these days
