I am employer and employee of a limited company. I am sole director and sole employee.

I am pregnant now and do not qualify for SMP.
My accountant has posted SMP1 form on company's behalf.

As an employee I can apply for MA1 and have eligibility for it.

But then, I do NOT want to claim any maternity allowance. But I am going to take break from work for at least 6months

    My question now is:
Should I make my company dormant during my break.
(Are there any advantages or required reasons of making the company inactive when I am not at work)

    Or

should I keep the company active and keep generating payslips.
(I am not going to claim any kind of allowances from gov or job center plus)

I want to take an appropriate action that's adheres with employment and business policy and not do anything that's wrong.

You cannot make your company dormant for such a short time.

You will need to keep doing RTI returns. HMRC advice on what to do if no payroll is being run as no staff are being paid for a number of months is at the bottom of this page.

Thank you for the response. I will rule out the option of keeping the company dormant.

    Now the question is:
I won't be terminating myself from employment because of maternity break. I will just be on long leave and then joining back on same role/position.

Would it not be a good option to keep generating payroll when I am on leave. Like paying an employee when they are on leave.

You can pay yourself or just send in nil returns.
