Just a quick question.

    I have recently started setting up a small business, selling lets say cooking products for the sake of the story. I have came up with a name for my business and have started making a website and putting everything in place. I have done my research and couldn't find any other business in the same sector with a same business name. However, today I came across an Instagram page in a foreign country advertising the same products with the exact same name. This wasn't a big page around 150 followers and their posts only go back about 6 months, they also didn't have any links to their store that I could see. I was just wondering if this would be anything to worry about or is it not worth thinking about considering how small this page is and the fact its in a foreign country? Any response would be great, thank you for reading.

    All the text is in spanish so I assume either spain or a latin american country, cheers.

    The only reason I asked was if say it was US or China you may want to re-think especially the latter who could copy or produce what you do in much larger quantities and possible divert business away from you. One other thing I would suggest is to make sure they are not linked in anyway to a much larger orgernisation especially if US based as they will come down on you like a ton of bricks. My son has a client who was selling sportswear using it turned out the same name as a US company caused a lot of grief and expense they have now had to rebrand their whole business.     You may also want to look at getting a trademark for your brand/name for added protection in the future. If someone was to object to you using that name then they would likely make contact during the TM application process and therefore before your business grows bigger. Best to find out now if it's going to be a problem rather than in the future when you have thousands of pounds into the business/brand etc.

    You can check free online for existing trademarks which may help you determine how big the other company you speak of is.

    I literally just think its a Instagram page cant find any links to a store or separate website, so don't think it's anything to worry about. Thanks for the feedback though, goodluck to you and your son aswell.

    Yes this is something I would definitely look into, I don't think this other entity has anything as such so don't need to worry about that. Definitely looking to get my business trademarked down the line though, nice one for the reply Matthew.

    If that page has few followers then you should not be worried about it. But you will need work harder do paid promotions and gain more audience. This will help you grow your business in a fast way.
