Issuing P45 when employee owes money

    Hi everyone,

    Under “The Income Tax (PAYE) Regulations 2003”, employer must issue P45 to an employee, when he/she leaves , its a legal obligation employer has to comply with

    However if an employee owes money to the company, could we mention that we will keep his/her P45 until owed money repaid, as a try to get something back?

    I just wanted to get your thoughts on this or may be you had similar experience in the past and how you dealt with it.

    You already have access to methods of recovering money from an individual. No need to hold something ransom.
