How to reclaim amazon.com US to UK import VAT

    Hi,

    I am UK business with a GB VAT and EORI number, I'm looking to import an expensive computer item from amazon.com (US) to the UK as its not available to purchase anywhere in the UK/Europe, the item is shipped and sold by amazon.com (ie not a third party seller) .

    Amazon.com pre-charge the VAT/duty using their "Import Fees Deposit" system, twice I have asked them via livechat what documentation they will supply showing the VAT as I need to claim it back from HMRC, they don't have a clue and claim they don't charge VAT.

    In this situation who should supply me with the VAT paperwork to allow the VAT to be claimed back on our VAT return, do I need to do anything before placing the order?

    If its prepaid then the seller provides the paperwork.

    I hope someone who knows of the inner workings of Amazon can shed light here - but the simple answer is whomsoever charges the VAT has to show that they have charged VAT in an invoice - but you know that already!

    I find it very hard to believe that Amazon in the US is the only entity on Planet Earth to sell something that is probably available world-wide. My first inclination would be to try Germany, as most wholesalers there also service the countries bordering on Germany.

    Silly question, but what is it?

    Its just a high spec laptop, amazon.de shows available in 1-2 months and I've found no stock in Europe despite extensive research.

    It seems impossible to find out before ordering whether I will get the correct paperwork, they have told me a "tax specialist" will email me but they never do, this is how the latest livechat went:-

    ME: I am trying to find out how to get an invoice for VAT charged on UK imports as I am a business with a UK VAT and EORI number
    AMAZON: This is something that is handled by a tax specialist and they unfortunately don't have chat support. I can forward your request to them if you can bear with me for just a moment
    ME: Can you just answer the question, its not really a specialist question
    AMAZON: The only information I have about VAT invoices it that Amazon doesn't charge VAT on physical orders delivered outside the US
    In terms of how you can receive an invoice, I wouldn't know I'm really sorry
    ME: I have a laptop in the cart and Amazon is charging GBP 317.20 VAT so how can you say you don't charge VAT?
    AMAZON: That is the reason I'm forwarding your request to a tax specialist. They are trained in this and can better assist you

    Is that definitely import VAT or some kind of sales tax?

    If it is import VAT then I can only assume Amazon will customs clear goods in their own name using their UK VAT credentials, but then they would claim it back themselves so why are they invoicing you this in the first place?

    Normally, it would be delivered by courier and they would contact you to get payment of any import VAT prior to delivery. They would normally have your VAT number or ask this for you in advance if not, and you would then claim this back on your VAT return.

    Well they call it "Import Fees Deposit" and its exactly 20% of the purchase price, their description of this 20% charge is:-

    When you order products from AmazonGlobal for shipment to countries or regions outside of the U.S. or from Amazon Global Store for shipment to the U.S., an estimate of the Import Fees will be levied on those items in your order. With your authorization, these funds are used by the carrier or another agent to pay the Import Fees on your behalf (or the recipient's behalf) to the appropriate authorities of the destination country ("Import Fees Deposit"). The payment of import fees is the responsibility of the importer and is levied based on the laws of the country into which the products are being shipped.

    So they aren't charging you VAT.

    Ahh Ok that makes a little more sense. So in that case yes it is an estimation of the import VAT that the courier will charge on clearance into the UK. Presumably then they will need your VAT number and will pass this onto the courier company for the customs clearance. You will then receive something called a C79 from HMRC, usually the following month, which is your evidence for your VAT return that you have paid import VAT and can claim it back.

    Those do not meet my spec requirements in anyway, I didn't start this thread to discuss laptop specs just how to recover amazon US VAT

    Ok so that makes sense, but at order time there is nowhere to enter a VAT number and amazon chat reps have no understanding of VAT, I think it is Yodel that deliver the amazon US items in the UK so maybe they pay the VAT on my behalf, I just have no idea how to get the correct paperwork or even who I should get it from.

    I've got a similar query on how to reclaim import VAT on Amazon Global purchases if you import to the UK.

    How it has worked is that Amazon pays the import VAT and has issued me with a VAT invoice (in the supplying countries language). There is no box when ordering to enter my EORI or Vat number.

    Can I simply log the expense using the Amazon VAT receipt and reclaim this VAT? I thought you had to have your EORI on the package when it goes through customs to reclaim import VAT. But if the invoice has Amazon's UK VAT number on, does this mean I can claim it as if it wasn't an import?
