Hi All,
I have started providing the leisure, sports & pub sectors with quiz machines e.g. Who wants to be a millionaire, Strike it rich,Beat The Clock,Hang Man,Trivial Pursuit etc., also Megatouch Games.Although all the premises have their own insurances do I need any for my own protection of the business.I dont charge them a rent for the machines we just split the profit 50/50.For example if someone got a shock from one of the machines who is liable. If the machine set on fire and burnt the premises down am I liable?
Any advice much appreciated.
Thanks
Malcolm

I would say get insurance anyway - at least that way you're covered. You should also have an agreement with the premises which clearly states the terms under which the machines are being rented. I would have thought that considering the machines would still belong to you, you would be responsible for them and any accidents caused by them. But it's never that clear - what if the shock was due to the premises' electrical system being at fault? Get a lawyer to draft this up for you and you'll save yourself a lot of headache (and money) later on.

Gary is correct - You need to have your T&Cs clearly stating where the bounderies lay. You will be liable if the machine itself causes a problem, but sometimes the problem could have been caused by the pub (getting smashed up by a drunken lowt!)

It does sound as though you need to get a more formal agreement, to stop headaches in the future as Gary says.

This is not a new issue, so it should be relatively easy to find out what the usual terms and conditions are and what your need for insurance is. Try approachung an insurance broker who deals with Sports and Social Clubs (a number came up on Google under a search for Insurance Gaming Machines)

Also speak to the people you are buying the machines from - they may be renting some out themselves so will have their own policy for this - who arranged the cover for them
