Fun times in Tesco! Most interesting thing to happen to me in a while...

So I was having a new radio fitted in to my van at Halfords and I had an hour to kill so I popped across to the massive Tesco store across the way. I was wandering round having a browse and killing time looking at a few things that genuinely interested me. I was looking at some cordless phones for my shop as well as some big plastic tubs that I was considering using for the delivery side of my business. I was also just wandering around the kitchen section trying to convince myself I needed that £129 grill.

After about 30 minutes of browsing and looking on my phone at reviews for the things I'd been looking at I decided to leave without purchasing anything. On the way down the escalator 3 security guards piled down towards me and naturally I jumped out of the way thinking they were just going to fly straight past me. Only they didn't...

I can't remember the exact wording but I was told to go with them and asked "You know why we've stopped you don't you?" I explained that I could take a guess but that they were wrong. They said they had seen me around the store looking suspicious etc and I said "I'll be wanting an apology from you once this is all over".

So everyone watched in disgust as the scumbag "thief" was escorted through the store and in to the back. I went past the packing area and through into a small box room with a couple of tables and a chair and a woman who looked like she wouldn't look out of place if she was wearing a rubber glove and holding a tub of Vaseline.

The woman's first words to me once I sat down was "So have you confessed yet?" to which I replied "confessed to what? How does this work? Do I just empty my pockets?". She said "yes" so I proceeded to empty them. I pulled out a wallet with about £2000 in it (was going to the bank afterwards) and a load of change (typical bloke) as well as a motorbike key and a small florists folding knife. Rather than apologising straight away she went on about my knife saying I shouldn't be carrying it in store. I apologised and said I didn't see the "no knives" sign when I walked in. I also pointed out that the store is full of much bigger knives.

She eventually apologised and said I was free to go but I said I wanted to speak to the security guard who treat me like dirt. She fetched him and he came in and again didn't immediately apologise. He kept saying how shady I looked and how they have to go off body language etc. I explained that there wasn't an issue with them suspecting me but with the way I was treat before I'd even been proven guilty. He said he didn't see anything wrong with the way he handled it and I explained that I am a customer who was accused of stealing and I'm very annoyed by the way I was treat. The very fact that I am annoyed is undeniable proof that the way he handled it was wrong. I said that I accept his apology and I want is a hand shake and a promise that the next person he pulls won't be embarrassed in the same way I was. He refused saying that he won't be changing the way he does things.

After a bit of chatting and me saying that if it was my shop this wouldn't have happened etc they offered me a free bottle of booze to which I declined. Then they offered some flowers for Mothers Day to which I also declined (I'm teetotal and also a florist!). I said I didn't want anything, just a promise it wouldn't happen again which unfortunately he couldn't give. He said he has never had this happened to him in the whole time he has been working there.

So that's it! Made my day interesting at least haha.

    I wonder what your legal rights are when a security guard tries to stop you.

    I suspect you can refuse to go with them and invite them to call the police to deal with you. If they try to manhandle you while you are not resisting, they'd be open to a charge of assault.

    Anyone can make a citizen's arrest, including a security guard. No one can make you go with them or prevent you leaving without making an arrest, including the police. If anyone makes an arrest, citizen or police, without reasonable grounds to believe that a crime has been committed, they themselves commit a crime.

    I would have refused to go with them in the first place and then had them arrested for wrongful arrest, probably assault and unlawful imprisonment. You would probably have got a great deal more than a free bottle of booze!

    I would have refused to go with them in the first place and then had them arrested for wrongful arrest, probably assault and unlawful imprisonment. You would probably have got a great deal more than a free bottle of booze!

    There used to be lots of cases of security guards ending up in trouble when they could not prove they knew a crime had been committed. Looking shifty is not a crime. If a security guard has seen someone put something in their pocket and walk towards the exit they are still safer to meet the person outside the store as they may have been intending to pay but never got the chance because they were stopped too soon.

    they make my laugh the security guards.

    I do this a lot. As soon as I find something wrong I write an letter of complaint (well, email). Usually big companies don't care so will just send you vouchers. I have had plenty of vouchers and even a free meal!

    Most Tesco security is hired in from agencies and they don't seem to see the difference between securing someone from stealing and a drunk on Friday.

    Had a few run ins in my time for looking "shifty" and I just tell them to bog off until they catch me actually doing something.

    Ring the store and speak to the store manager and make a complaint. they are the only ones with authority to do anything about the guard (normally means asking the agency to send someone else).

    That's all a bit odd - the security guards are unlikely to be acting on their own initiative because they generally don't have any. They're normally co-ordinated by the cctv guys. They must think they saw something .......

    On the arrest side, you can refuse to return with them and go on your way; they will then arrest you because you've satisfied the second part of the formulae (that you're getting away).

    For the the first part, they only need reasonable grounds to suspect you. Normally that would be actually seeing you nick something or, more usually, they'll have been told by the cctv guys that you've nicked something.

    I personally doubt that acting suspiciously is reasonable grounds for a citizen's arrest, I'd say you'd have to be bloody nearly sure.

    I'm very interested to hear Tesco's response, they should be grovelling as low as they can go.

    If you were taken to the back room, without choice, you were arrested. They don't actually have to say the words 'you are under arrest'. From what you have said, it appears they were wrong, and this was an unlawful arrest.

    I'm pretty sure a lawyers letter to head office will get them worried. Possibly they could stand to lose a lot more than a bottle of wine.

    Might be worth serving a DPA SAR notice to get a copy of the CCTV to use as evidence against them.

    Thanks for the info. Didn't know I could request CCTV footage. The more I think about the whole thing the more it is winding me up. I'm going to request the footage either way so at least I have it. There was obviously no footage of me actually stealing so they had no right to embarrass me like that.

    For fun and games, I sometimes try to look suspicious just to get some action. But nothing.. :(

    even when the beeper goes off at the door, unless im carrying a TV, they don't blink an eye!
    Could walk out with a bag with huge SWAG letters on it and they would still ignore me.

    Hhaha, Then look at the woman who comes over because of the flashing red light all teary eyes wondering why its not working.

    She then proceeds to swipe her card and let you carry on.

    I would complain. I have had the same thing happen even when I was wearing a tweed jacket and a tie. my complaint was that I would have happily walked with them but instead got bundled through to the back.
    You could always settle for an hour with the lady, Vaseline and the rubber gloves! (oh god I can see the moderators chucking me off the forum.)

    If you got to centre parcs, always complain as they will give you a £30 food voucher! but you then have to spend £500 to go.


    Hopefully you're saying that tongue in cheek, but I'm wondering how you'd feel if all your customers were being told to complain every time you did work for them so they'd get money back?

    Surely you only complain if there's something actually wrong, not 'always complain'?

    There seems to be a hint of paranoia in the UK a few weeks ago i was working around London Bridge station when i decided to go out for a starbucks only to be told by a PCSO that the 12" metal rule i had in my pocket looked like a blade :eek:

    I pulled it out in front of him and told him its a 12" metal rule that i use for work, he still says it looks like a blade and i should have it covered up :mad:

    Yeah, I got quite some compensation from John Lewis on Oxford Street many moons ago when some over zealous jobsworth thought he'd act all hero like and attack me on the way out of the store, even though I was carrying a John Lewis bag with my purchases and receipt in it !

    Well it's been nearly 24hrs since I complained and not a word from them. Hopefully this means they are trying to figure out their next course of action ; )

    I tried requesting CCTV footage once but the (different) store wouldn't give it to me. It was only over a small matter though.

    It is worth mentioning at some point that you were looking at a [specific model] grill that you were thinking of purchasing, and how after this incidence you will most certainly be purchasing it somewhere else. It's almost guaranteed to get you a hefty discount on the grill!!

    I have actually laughed out loud reading this thread! So I thank you all for that.

    This has happened to me also - Although it was the till assistant that collared me, and it was in Toy Master.... Apparently, he didn't understand that the pay point for the remote controlled cars was upstairs and you had to go back downstairs and through the till area to leave - receipt in hand.

    He felt it appropriate to grab me by the wrist and yank me backwards - While I was with my wife and two young children. Needless to say (chief complainer here) walked away with a full refund and the car.

    I have just been on the phone to Craig the Duty Manager who is in charge today, Craig is very concerned to hear this, and wants to say how truly sorry he is. The security guards should not have pulled you in the office unless they physically see you stealing from the store, so this is very disappointing.
    Further to this Craig is going to speak with the Security Manager to make sure this gets looked into as soon as possible, because this is not the way we deal with things in store and the staff need to be made aware of the mistakes and the correct process here.
    I would like to send you a £20 Tesco Moneycard from myself to say how sorry I am you have to go through this embarrassing ordeal, I’m not sure if you would want to go back into the store but you can use this in any store or petrol station.
