Copyright of photo's

I am in the process of setting up a network of media websites that rely heavily on the use of photographs

I am not making any money directly from these images, and all of the websites are 100% free to use, the only source of income is going to be selling advertising space.

I know there are laws allowing the use of copyrighted images in a certain context and to a certain degree, my question is, would I be able to use copyrighted photographs as long as I credit the photographer and/or copyright owner?

Thanks

Unwise to do so without express permission as your site is a commercial one. Different rules apply for educational purposes but where there is a commercial element as yours is advertising, don't run the risk of being sued for publishing the photograph. Much easier to retain business credibility with licences in place to use the photographs or have your own taken for site display.

In regards of the last sentence, you might, if you're not a great photographer, consider asking at your local college/university if there are some photograph students who might consider taking them for you.

You would need to provide "a brief" of what you want. Chances are that they'll be grateful of the opportunity, be guided by their lecturer and will be able to use this for a course work project and get an insight for their professional careers. The copyright issue can be worked out with those you employ.

When so many people who apply for jobs getting turned down for lack of experience, this would at least give them a chance to put your project onto their CV.

I don't think that it's possible to use a photo of another person's photo or copyrighted images. There are certain laws and rules for that. You may want to check that out on the internet.

Your safest bet is to buy from stock sites, and also ensure photographs that feature people have their model release forms.

Depending on what you need, you could also commission somebody to provide you with the images, and exclusive rights. If you're interested, message me your brief and I will provide you with a competitive quote for providing you with the images.

Even if you buy an image from a stock site does not guarantee its free from copyright. I repeat.......................check out the FSB Discussion Forum. I believe a photographer received a demand for payment from copyright and patent agents for his own photograph!!!! thats how much of a problem this particular situation creates.

Even buying from an online photograph agency can have problems, the models may have issues being associated with certain products or companies. You really need to look at the small print, or better still contact the legel dept from the Camber of Commerce or FSB and get advice,

I was getting at this with the above comment. If you can, I'd really recommend getting your own images done, it doesn't have to cost a lot of money. By going specific to your requirement, you will set yourself apart.

You NEVER EVER have "Copyright free" images, the photographer ALWAYS keeps the copyright, what you have is a license to use it.

Sometimes what you mean to say and what comes out in print is different. What I meant was that even purchasing from a reputable stock site is no guarantee you will not receive a demand for using copyright images, despite paying for the appropriate licence. It's worth checking the FSB Discussion Forum on this very subject.

I'm not sure if I follow, but are you relating to the possibility that the image you have bought was fraudulantly supplied to the stock image provider, and then the actual photographer, demanding payment?

I've heard of this case before if so/
