Hi,

I was wondering if anyone could give me some advice.

I am due to start a new role in about a months time for a marketing agency and my current employer has approached me to continue some of my work after I leave. I have read through my new contract and cant find anything and I can't see that it is a conflict of interest as long as I am doing the additional work in my own time. Do I need to inform my new employer of this or my intention to do this?

If I were your new employer I would not be happy at your doing this - I would not be employing you expecting you to be also working outside for a competitor - not a good start to a new job.

There is also potential for huge conflicts of interest / timing etc. - what if both need something done by a specific time? Which takes priority - both are paying you...

If you do this you are in affect holding down two jobs and therefore there will be tensions.

The new employer will pick it up as any new income is likely to affect your tax code and they will want to know why...

I would talk to them about it...
