Hello everyone,

I am a self employed person, and I am currently in maternity.
I applied for my maternity allowance three weeks ago, just few days before baby was born.

My partner and I had some holiday booked from last year, and he’s also going to take his paternity leave.

I was wondering if it would be possible for us to go on that holiday while I’m still on maternity? I remember being told on the phone by a person at Job Center That my maternity allowance would have stopped, should I have gone on holiday.

I might have misunderstood, is there anyone who can advise?

As Simon says, how can they possibly know?

In any case, I believe the person you spoke to at the job centre has confused maternity allowance for a self employed person with maternity pay from an employer.

If you are on maternity leave, you can not take holiday that you may have accrued from your employer. If you did, this would effectively end your maternity leave.

You can however, go away on holiday, as you are not in work. This is the same for a person receiving maternity allowance. They can not dictate to you how you spend that time beyond telling you that to be entitled to it you shouldn’t be working.
