AMAZON FBA - RED FLAG OR OPPORTUNITY!?

    Hey! (newbie here)
    Going to keep this really simple...

    Ive found a product... There is only one seller on amazon selling this item. 813 monthly sales/40k$ revenue pm/product went on sale 03/19 - 431 reviews.
    I cant find patent or trademark for this item. I have looked!
    I like this product. Ive found the factory in china that produces this product and they are happy to sell it to me. I can improve on this product.

    My query is essentially - Is this good practise to go head to head with one successful seller? if there is only one successful seller with this item does that mean demand is super low? Would this be a red flag to a more seasoned FBA seller? Any thoughts, input, advise would be humbly received...

    If you can improve on it then it's not the same product. Need a new product page which may take years to get to that level.

    By all means go for it. Expect current seller to respond.

    Including legal action. Does not have to be kosher, just enough to kick you off.

    You want to take the chance? Could be worth it.

    What sort of legal action could he take for example?

    Did you mean that his legal action doesnt have to be kosher in order for me to be kicked off?

    Have heard of people who don't have the trademark / IP rights having others account suspended.

    On one occasion a small (circa £200k seller) claimed IP of a Disney item and got another seller suspended for a few weeks.

    It looks like you plucked those numbers out of a tool like Jungle Scout or Helium10 - take them with a big pinch of salt.
