Sent by Airsure from UK To Belguim Not Recieved

    Hi all


    I once sold an item for £90 and posted to Greece and buyer said: They never received the item, and opened up a paypal dispute, so i sent paypal proof of postage via fax.

    They said thanks but that doesnt mean they got it, so they advised me send by Airsure, now i have an ecommerce site and for small items i use this service.

    Now i sent a small item worth £90 to Belguim and the day it was delivered the buyer said: Look where is my item? i said its been delivered.

    Now they are saying they have not recived it but persoanlly i think they did get it...

    It says on Royal Mails websire it was delivered the day they called me up n the phone.

    Now the question is legally...

    What am i supposed to do?

    I cant afford to send a new one...

    They are in Belgium, i have kept proof of postage and it says it has been delivered:|

    The POD should have a name on it. Is your customer disputing that the named person didn't receive it, or that the named person is incorrect........?

    I'm trying to understand why they say that it wasn't delivered.

    (the only airmail problem we ever had was with a bloke in belgium - must be something in the water!!)

    you should be able to get a signed POD, but it may cost a few quid.

    Sounds like a bit of a fraudster you are dealing with!

    I wouldn't bother requesting the proof of delivery, just file a claim against Royal Mail and let your customer know.

    The following text, taken from their website, tells you how to do this:-

    How do I make a claim?
    Visit our Customer Services section to make a claim, or use form P58 which is available from your local Post Office™ and send it together with proof of posting to your local Customer Service Centre. Claims can take up to three months to complete because we have to wait for overseas postal administrations to respond to our enquiries.

    If you believe your item has not been delivered, please allow up to 20 days after posting for items sent to Europe, and 25 days after posting for all other items, before you consider it lost. This is because your item may have been held in customs or could be in the process of being returned to you if it could not be delivered for some reason.

    Royal Mail does not accept any claims for delay as delivery times are not guaranteed.

    Thanks for that, i am trying to find out legally what am i supposed to do, if i have sent it, It says its been delivered, I persoanlly think because they didnt have to sign there like, Hey where is my detacher? They also said they really needed it asap for this African charity shop??? MMMMMMM

    So where do i stand? it says its been delivered, there saying they never got it?

    Legally do i still have to send a new one? Would any other retailers do that ?

    here is the last email they sent:

    Excuse me sir but do you mean to say that you send packages overseas to be just delivered without anyone signing for them? Because, this is not my first online purchase and the packages always have to be signed for. The postman rings the bell at the address and whoever answers must sign for the delivery, at least that's how it works in Belgium. No packages are "delivered" without somebody signing for them - and in the event that they ring the bell and nobody's home then they leave a note asking the addressee to collect the package personally at a specified post office.
    Just for information, till what point does this Aisure deliver, till the goods are in Belgium to be delivered to individual addresses by the Belgian Post; or till they reach the client? It's absurd that any self respecting courier service would "deliver" a package and not have somebody to sign for it - and I know that nobody did because there's just two people in my house and neither of us did.
    And just what does "electronic confirmation of delivery" mean, it says so on the label?
    Well, we can't afford to order another one so would you be so kind as to ensure that we get this one?

    I think all you need to do at the moment is investigate the apparent missing delivery by filing a claim as previously stated.

    You know you sent the package, Royal Mail say it was delivered, the customer says it wasn't received. You seem to believe everyone apart from the customer so let Royal Mail deal with it.

    I have no doubt the customer has received it but seems to know you can't prove it.

    Next time ensure your packages are sent both signed for and fully insured.

    Thanks for that, i am going to do just that i have already updated my website in the terms and conditions that it is the buyers choice to pay for full tracking roughly £40 as to the £10 for airsure, :(

    I think this is okay for me to do this, but if anyone knows different please let me know.
