Hi,

I am in the process of writing my business plan for a new business that I am going to be launching in the Spring.

I have a great idea for a business name, and can't find it on companies house, and a domain name for it too.

Are there any other things I should be doing to ensure that no one else is using the name, so that I'm not going to get myself into hot water.

Is it travel based?

Looks like you have your hands full with businesses!!

Try Philip at Crossguard, he's an expert in this stuff. He'll send you a price list and how to protect you new name if you PM him! It's pretty heavy going understanding all this stuff.

I don't know if registering as Limited does the job. But here's somewhere that you can protect it

I'm sure I've read on this forum a number of times that the National Business Register cannot protect your name and that using a registered trademark was the only sure-fire way.

One for the legal bods methinks.

You're absolutely correct, Joyous. Trademarking is the only way. I have taken legal advice on thisand Philip from Crossguard is processing my documents.

They provide the service, but have no legal 'clout' or legislation to enforce any contravention of protection.

The National Business Register is in my opinion misleading people in thinking they are a 'statutory body' and offer some kind of 'protection'. They are merely a private business making money from the lack of knowledge of others who are new in business

Trade mark is the ONLY way. I also recommend Philip at Crossguard. His email is [email protected]

You must check out any name from a trade mark perspective - trade mark rights provide a monopoly over everything.

If you go ahead without a trade mark search, you are really making your new business venture a hostage to fortune - we recently had someone be forced to change their main product name a month before a major exhibition.

Call me and I can advise you what's involved.
