Help With Domains

let me explain:
- a client has registered their domain in there own name
- the client then had there website built and hosted by another company
- this second company transferred the domain from the original domain hosting company to their own domain servers
- when they transferred the domain hosting over, they changed the name the domain was registered in to their own name.
- the client paid for all of the transfer costs.

we have now been commissioned to take over the web hosting and development as the client was not happy with this company.

The problem is we cannot now point the domain to our servers as the domain hosting is with them.

does this mean that legally the domain is now owned by the development company?
how can we get it back?
 
yes they own it and unfortunately there is little you can do except offering a price for it.

If the whois is in their name, they pretty much own it.

Folks, always keep YOUR domains in YOUR accounts and in YOUR name :(

Have they been asked to transfer the domain name?

was the client advised they were changing the registered details on the domain?

Did this happen at the renewal time for the domain or only when they changed the registrar?

I am hearing about this happening more and more! As far as I an concerned the domain belongs to the original owner unless he agreed to the change of ownership details or sold the domain.
People must become more careful or companies will do this more and more.

To me it is just a scam

If the company changed the domain to their name their client should take legal advice. Might be enough to scare them into giving it back.

Alternatively you could go to the top-level registrar (Enom, Godaddy, etc) and ask for assistance.
