    Even if you had it before them, it may just be a case of whos got the bigger budget to spend on legal action.

    Ive known many people to be crushed like this, most of the time theres nothing you can do about it.

    Sorry to be so pessimistic.

    Eagle is basically right, but you need to be careful not to confuse trade marks and copyright - the first protects against confusing similarity regardless of intent (so trade mark rights are always related to a business but innocence is no defence), whereas copyright depends on whether copying has taken place regardless of what the copy is applied to (so two people can take separate photographs of the same view and not infringe even if they look identical, but you can't copy Eagle's logo on a label for any product whatsoever).

    You can get both trade mark rights and copyright in a logo, but only trade mark rights in name.
