Holiday Pay

Hello Everyone,

I am very new with Paye and NICs. Can someone please help me with holiday pay, I have a guy who work 5 days weekly his hours are 40 hours per week, he earn £9.88 per hours, he is in week two of his employment, he has asked for 2 weeks paid holiday and his extra basic pay is to be paid with his week 2 wages.

Could someone please give me an explaination how I can work this would it be by hours or days? I know he is entitle to 28 days leave because he work 5 days week. I am at a lost with the rest.

He should only take off holiday that he has accrued to date and he has to take the time off, not have it paid to him as extra with his wages.

And don't forget that the 28 paid days includes bank holidays.

You've got to admire the front of someone who "week 2" is asking for 2 weeks paid holiday. I think it is perfectly reasonable to say that for the first year of employment an employee can only take paid holiday that they've accrued at the 12.1% rate. If he has a pre-booked holiday soon then perhaps it will have to be unpaid leave, unless you're prepared to be incredibly trusting.

Or have a signed clause to the effect that you can recover the money from him.

Point out to him that we have 3 million unemployed and he may change his tune!
