certificate of origin

Hi,

I am staring a golf clothing company and I have order ordered 500 polo shirts from a supplier in China, this is just a small order to test the suppliers quality etc.

The supplier has a good repution and widley used throughout the world. Due to my order been small they added it onto the end of thier productionn run prior to going on holiday for 3 weeks (the comapny was shuting for this period due to the new year). This was to ensure that I could receive my goods as soon as possible.

They sent the good using UPS and they arrived int he Uk on the 10th Feb. They are currently been held by UPS for not having a certificate of origin with them. I was not told that I needed this certificate and due to the comany still been on holdiay I am unable to get one from them. My goods are currently building up charges at UPS (£11 per day per package, I have 16 pakages). Prior to the goods been sent I spoke with the supplier, UPS and HMRC to ensure that I had done everything that was needed, and was not told to ensure this certificate was with the goods.

Who's responsiblilty was this, was it mine & should I have asked the supplier to send it with the goods or should they have know? Then should have UPS Hong Knog sent the goods to the UK with out it?

What do I need to do to stop getting charged by UPS & to receive my goods as soon as possible? I have tried to contact the supplier but they are still on holiday.

New Years has finished in China and all should be back at work.

Sorry,i can not help you with your problem as i have never heard of this before.

I have had many parcels from China,by various couriers,and never had one " held " for a certificate of origin ( customs clearance,yes,but your agent should have dealt with this ).

You should have a shipping note attached to at least one of the packages,which should be mainly in Chinese ( in my experience ).

Is this not proof enough of " Origin " ?

A certificate of origin is generally required for shipments of textile goods for UK customs clearance purposes.

In my opinion, if your supplier in China regularly deals with export orders they should know that one is required and should have sent it with the goods.

It is a bit of a grey area whether UPS in Hong Kong should or shouldn't have sent the packages without the cert. A cert would not have been required for the export clearance from HK.

UPS will not be able to customs clear the goods without the cert so you will need to badger your supplier to send the necessary document to you by courier ASAP.

UPS will also require you to pay the storage charges before they deliver the goods to you.

You could try and get some compensation from your supplier but in all honesty unless they believe you will be a major client in the future I think you may have to take the charges on the chin and learn from it.

(I would not recommend pursuing them for compensation until after they have sent you the required cert of origin otherwise they may not co-operate and you will have even more problems!)
