Please may I run a scenario past you with some random figures in to make the math quicker!
Assume I earn £120,000pa. Assume the company deducts £1000 from salary (post tax) for pension, and pays in 5% itself
This means the pension receives £1250 from me (tax auto applied) and £500 from company.
Great (if only!!!)
Now lets assume these deductions continued, and it was noticed that for 4 months NO PAYMENTS were made to the pension fund; then on the 5th months it is applied back dated with no notification as to why. (only saw when checking detail on yearly pension statement from provider)
In addition, the bulk payment was wrong and it was wrong in other amounts so they owe me a fair sum from the whole pension cock up.
I am no longer an employee, and have requested it to be resolved, but keep getting told "we're busy and I don't have time". I understand that other people are affected but no idea to what extent.
Personally I believe its more due to crap processes rather than deliberate, yet the company has recently downsized etc.
Is this legal? It stinks of either incompetent finance manager or illegal (?) borrowing of the funds by the company. I understand under the pension act all deductions from salary must be paid in to pension by 19th of the following month?
Apart from simply asking for it to be sorted, is there anything I can do? How long do I give them from notification before taking the next step? And what is that step?
