View Full Version : Employment Tribunal Claim - Company Liquidation

A friend was dismissed from a small limited company last year for gross misconduct. He has made a claim to the employment tribunal for unfair dismissal, unlawful deduction of wages & discrimination. The claim has been made against the company & two named directors.

The hearing date is set for September & he has a strong case for the unfair dismissal as there is no evidence of gross misconduct & procedure was completely ignored when he was dismissed. However, the company is now threatening liquidation.

If the company is able to liquidate prior to the hearing will the unfair dismissal claim be thrown out? Is there anyway my friend can stop this? It's not so much the financial compensation but he wants to clear his name as it's having a detrimental effect on his professional reputation.

If the co is unable/unwilling to pay then there is a scheme whereby he can be paid via the DTI instead.
