Hello, first I should introduce my self in a right threat of the forum but I'm a bit in hurry. My name is Ivica (read eeveetza) I'm from Macedonia. I heave this exam on KCB (Kensignton college of business) in Macedonia, abaout business law system, but I'm not realy familiar with UK law system, so I can use I little help (little for you, much for me).
So here are my model questions for my final exam.
Question 1
Explain the major sources of English law.
Question 2
a) What test exists for determining whether a person is employed or self employed under the doctrine of vicarious liability?
b) Using cases illustrate how the courts have determined whether or not an employer may be liable for the actions of his/her employees.
Question 3
Bill and Ben have run a successful computer back up service for a number of years. They are self-employed. They have decided to put this business on a sounder footing. Explain the advantages and disadvantages to them adopting either a partnership or a registered company.
Question 4
The last forty years have seen a massive growth in the use of arbitration as a means of settling business disputes. Explain the advantages and disadvantages to arbitration.
Question 5
Cookit Ltd supply catering equipment. They supplied 400 ovens to the Midshire Education Authority (M.E.A.) for use in their domestic science classes.
M.E.A. signed an agreement. Clause 10 of which stated 'Cookit accept no liability for any defects in their products'.
The ovens supplied have proven to be unsatisfactory for their purpose. M.E.A, are seeking damages but Cookit Ltd have brought their attention the exclusion clause.
Advise Midshire Education Authority.

Spice is a successful band whose music is renowned throughout the world. In April 2007 the five members of the band agreed, for a fee of £250,000, to do a photo shoot to promote electric powered cars for Ecocar Ltd. This was despite the fact that it was becoming obvious that the band would soon split up. After the photo shoot two members of the band left. The photos Ecocar Ltd has taken are now worthless.
Ecocar Ltd is considering suing for misrepresentation. Advise Ecocar on the stages that they have to go through to succeed in such an action.
Question 7
For an agreement to take on the status of a contract it is essential, among other things, that there are an offer and an acceptance. Discuss the main points to these elements.
Question 8
It is through the medium of principal and agency that many contracts are affected. Examine how a principal may be bound by his agent and the key exceptions.
