Hypothetical question, but if a sole trader is operating near me and I register
a company with the same name as he is using, can I force him to stop using
the name?

Of course it also depends if he is actually doing the same type of business as you.

Almost certainly you can't stop him, if he's been using the name already.

If he uses his own name eg "John Smith Patios" then you certainly can't stop him using that.

As far as I was aware you had to trademark a name to totally protect it, therefore you could not stop someone who has already been using it to cease just because you form a limited company I would have thought!

No, and it's only hypothetical too.
I'm thinking along the lines of, if a one man very small sole trader is trading
using a really great punchy name, could a big company come along, like the
name and set up a limited comany using it?

Not to stop the sole trader working, but just to get possesion of the punchy
business name.

You can form a company with virtually any name you like but that doesn't give you the right to trade under that name if in doing so you would infringe another person's trade mark rights.

If you register a business name or brand at the Patent Office as a trade mark then you are still only entitled to sole use of that brand or name for the type of goods or services which you have registered the trade mark for but at least the trade mark is on public record as belonging to you and if someone does copy your business name idea then it is much easier to take action against them. If your business name is not registered as a trade mark then taking action against someone using the same or a similar brand is much more difficult.

It's much more likely that he will take action against you, but only if you are in the same business. This is called a "passing-off" action. Otherwise, why register the same name when you are already aware that someone else is using it ? I would steer clear unless it is an amazing name and you are dead set on it.

Registration of a limited company name gives you no legal rights in that name, it simply stops someone registering exactly the same thing - and if someoneone else is already using the name in a similar field they may be able to stop use of the limited company name by suing for passing off or trade mark infringement. (Trade mark registration gives a more powerful right.) The same applies to domain names.
