Hi,

Has anyone had a similar experience - help needed.

I have received a County Court Claim for a old partnership debt from 1999 - the partnership is long gone and I do not want to end up paying the whole debt.

Should this debt be classed as statute barred?

I have nothing against paying my debts but I just think this debt collection company is trying it on - they are charging interest on the debt of £1.60 a day. They are also talking about a charging order on my house.

Any help would be most useful.

How long has the DCA or the original creditor been chasing you?
Have you been avoiding the debt for a while and now they are starting to get more serious with you?

Hi,

Thanks for reply.

The DCA sent a letter in June 2007, another letter in Nov 2007, final one in Dec 2007 and now CC claim form.

Sorry, I should have been clearer in my question.

Have you been in contact with the original creditor or a debt collection agency within the last 6 years and either made a payment or admitted the debt?

No, I have'nt made any payments or made any arrangements.

When did they first start to chase you. Have they asked for any money from you within the 6 yrs of the debt?

Then under the statute of limitations act, they cannot enforce the debt, unless of course it is secured on land or property.

Is it unsecured?

Well I used the phrase "admitted the debt" rather than "made any arrangements".

If they haven't contacted you or you admitted the debt then you could have a defence using the limitation act.
