Hi,

I am trying to become a freelance business consultant. Now obviously I am not going to provide incorrect information to damage a company, however, what type of legal protection will I need. I presume having an effective terms and conditions and disclaimer would be enough cover if a contract is signed by both parties.

Two things you will require are

1) A reasonable engagement letter setting out your terms and conditions and also being specific about the agreed scope of the engagement. I doubt if a disclaimer would cover you fully and

2) A suitable Professional Indemnity insurance cover.

It is not possible to exclude liabilty for negligence but it is possible to limit exposure to a figure. This normally refelcts the insurance protection obtained under PI cover or if both parties agree at the commencement of the contract a fixed sum equal or slightly higher than the cost of the project.

Provided by a number of insurance companies eg loxton, Hiscox etc etc.

As to how much it will cost is a variable you will only discover by applying....it depends on type of consultancy, turnover etc

Ahh I thought that would be the case, I shall look in to that further when I have a bit of spare time then.
