Hi,

I am moving a charging order I have over a property to the next level by going for "Order for sale"

I understand that I need to complete form PD72 (Order for sale).

The form requires certain information I am unsure of where to obtain,

This is the section which states the minimum price the property is to be sold for.

Can anyone provide some guidance on anything I must do before submitting this form to the court.

In addition as I am not a solicitor can I act as the agent to arrange sale.

The problem is that I have spend plenty of £££ over the last 4 years to get to the point I am at, and really do not want to spend more unless I really have to.

You will not be able to normally deal with a sale of the property yourself if there are charges over the property. Those charges have to be vacated by a solicitor and you will also have problems in dealing with purchasers as many will use solicitors who may refuse to deal other than with a solicitor.


The good news is that if you are successful with obtaining the order for sale, if the equity released is more than your current debt, all of your costs including the solicitors costs on sale can be added to your order. In most cases the court order sale and a list of actions to be taken and may supervise and actually be involved in the process depending on how much is involved.

You should check on the land registry site as to whether the property has any charges and if so you tell the judge on the application and they can order the mortgage company or loan company to advise on the redemption amounts.
