Ideally you should put your claim in writing to the site owner that you claim copyright infringement and possibly passing off. You should state a deadline to rectify the infringement or you will issue proceedings etc.
If you email me below I can give advice on Tuesday

Another thing you can do is hit them (or threaten to hit them) with a DMCA in Google. If you can prove they've stolen your content (eg try web.archive.org) you can get a substantial part of their site removed from Google's listings.
Have a look at http://www.google.com/dmca.html
to see how it can work. Yahoo and MSN have a similar policy.

thanks guys , Handsongroup i have sent you an email, i have checked webarchive.org but its only up to last year 2005 so his website didnt show up, but i just hope he changes his text and apologise the guy is probably struggling by the look of things so i'm not going to get a penny even if i sue, i'm glad he has changed some the text on his homepage and removed all the pictures but other pages still the same as mine, i sent an email and the owners blame the designer, so its now time to name and shame this designer
