Is the statement blow true i had no ides this was a factor in local ranking


Check your WHOIS information

The best way to verify this is to do straw test on the local result and check the whois on the ranking domain.

But some businesses without domains also rank well in local search so it may be a factor but not a big one.

Google uses who is to confirm ownership of multiple websites

your whois data has ZERO effect on ranking - listing (from google especially local business / google places) use differnt methods of varification of your business, other localisation is based on data on your site - search engines aren't stupid they know designers and developers will register sites for clients and therefore don't take this into account.
