View Full Version : Can I register a bad debt onto my clients credit history?

Hi,
As a Limitied company, is it possible for me to inform credit agencies that a client of mine is withholding payment or not paying his invoices? This would allow other businesses, considering working with this client, to be able to judge credit worthiness.

I think you can only do this with agreements under the Consumer Credit Act and Hire Purchases. The best course of action would be to take legal action.

Hi,
I haven't taken him to Small claims yet, and the debt is only £550. Therefore I haven't thaught it possible to use an agent.
The contract was verbal. I have several emails written by the client during the project which refer to the cost and the work which was specified. Therefore I am not sure if this is sufficient to issue proceedings.

as per my PM, I'd suggest you give Nic at Admiral a call to see if anything can be done. Perhaps not but it's worth finding out.

Nic - since you quoted me, was you actually implying anything with your statement?
Phil - are you a Ltd Company?
If you email me I can certainly assess the merits of your claim and advise whether a claim in the County Court would be cost-effective. If you are uncertain as to whether the contract is enforceable then you do need legal advice. I am happy to give initial advice at no cost
