Hi All

I need some legal advice please.

If a am to sell a product and it contains an Image (the funny JPEG images you get sent by e-mail of people drunk and doing silly stuff) will that be against the law. As far as I know they are not copyrighted. Could I get into trouble??

Two things on this one spring to mind. Firstly most images are copyrighted and this should be checked out before use in an email.


Secondly and more importantly have you the recipient's consent to receive email and are you sure you are keeping within the boundaries of the legislation on emails and other types of telecommunications?

I would be happy to look at this for you if you send over a copy of what you intend to send and where in general terms you are sending it by email to me.

All images are copyright automatically unless very old, and you might also need to look at data protection if people's identities can be ascertained from the images concerned - Jonathan of Hands On Group might know more about the latter.

I'd advise sourcing images from a stock photo library or creating your own.

I would just like to say that the photograph was taken without my knowledge, and in my defence I was very very drunk. I don't normally behave like in public and I put my clothes back on very quickly when the police drove past (hic) :D :D :D
