View Full Version : Legal wording for website (re: a registered trademark)

Hi all, now that my trademark is registered :D , I want to display the 'r' symbol next to my logo and also post a small legal notice saying something along the lines of

'the xyz logo is a registered trademark of xyz and as such must not be copied blah blah, trademark infringement blah blah, we will consider legal action blah blah etc etc.........

Has anyone here posted a similar legal notice for their sites that I can look at (I won't copy it, but just need some inspiration)

I am currently involved in a dispute over the use of the business name :twisted: , so want to get something on the site fairly quickly.

Hi Claire,

Take a look at our site (footer of each page) and also our Registered Trademark on our term & conditions page. Roll and hold your mouse/cursor over the Regd. Mark to view the ALT Tag.

I don't think you need a legal notice as such, what we have is usually sufficient to deter.

The 'R' in a circle symbol plus if you wish e.g. "Bloggo is a registered trade mark of John Smith Ltd" is useful (a) as a deterrent and (b) to show that your business is conducted professionally.

By the way, 'TM' can be used by anybody, it's simply a claim to trade mark rights but not necessarily registration.

Hi Claire,

Some clauses that you could use as follows:-

Trademarks:

"You acknowledge that we are the owner of the trademarks appearing on or used in relation to the {product} and the associated goodwill. Unless we expressly agree, you have no right or licence to use all or any of them".

Copyright:

"You acknowledge that copyright in our {brochure} belongs to us and you undertake not to reproduce or translate it (in whole or in part) without our consent. Any reproduction or translation shall belong to us, and your right to use them will cease on termination of this agreement".

thanks pilfo and crossguard, i have displayed the r symbol (i have waited a long time to be able to do that) :D

Anyway thanks for the advise. Crossgard (Phillip), I sent you an email earlier today, hope it arrived ok!
