View Full Version : Price Increase after Invoice and Payment.

Please can somebody help me.
I have recently purchase some items on a proforma basis.

We received a quote & Invoice but due to a admin slip we did not pay it for a month (the goods of cause were not delivered)

On realizing our error we requested an updated invoice and on receipt of that we paid by return.

Three days later ... still no delivery

We chased this but were told to items had gone up in price as they are not ordered in until payment is received 'as stated on the quote in terms and conditions!' (These terms and conditions are nowhere to be seen.)

We were then told the terms and conditions were on the website, not the quote. (These also are nowhere to be seen)

Is it acceptable to do this? Is it legal?

We paid the additional money (total order value in order of £700) however we are still waiting for delivery over 7 days later.

Any help would be appreciated.

Was there a specified timeframe for delivery? If there was, they have breached the terms of the contract, and you can demand an immediate refund...IMO

Saves having to argue the legality of proforma's and quotes - if they should have delivered by now, and haven't, get your money back!

The time frame on the quote was 1 week, however we are aware we paid late BUT we did request an updated invoice prior to paying to make sure it was correct. They have now arrived and when I contacted them to request some sort of compensation so as we could offer to our customer they stated they would not and in their words 'can't be bothered with you!'

Well that sort of answers your question. They really don't want your custom and you aren't going to get any joy asking for compensation.

Reading your original post it seems you placed an order but didn't comply with the T&C (1 week to make the payment). As a result anything from that date onwards would be a new order at the latest prices.

It was 1 week delivery from order/payment. As we understood it the items were in stock. When we first chased (and found we had not paid) we where told the items were ready and waiting payment... no mention of price change or the fact they had not even ordered them! They have no T&C on their quote or website. But I agree it is not really worth our time fighting a company that quite clearly are a law unto themselves! Thankyou for your help.
