Legal Help Please

I have a really rude member on my site who has unfortunately won a prize. I have specified that all prizes will be sent once all names are collected (this is because the prizes come from elsewhere) and basically she is threatening to sue me if she does not receive them within 14 days and has threatened to contact ASA and quoted CAP if I do not. Can she do this?

What were the terms of the competition? I thought normally the final decision is yours as the competition host?

I made it clear that all prizes would be sent once names were received but shes not happy with that!

Did you have rules and terms ect for the competition? Most competitions in papers etc, give a time when they would get their prizes, usually a month, to 3 months.

If I were you I'd hurry the prizes up, then tell her to naff off and ban her from your site :D You can do without nasty cows like that.

Don't forget to squash a stink bomb in her prize (see silly jokes, sure she'll have some), just for fun, call it a free extra :lol:

Because the prizes come from lots of different places I cant guarantee when they will be sent by and when they will arrive. I have always made it clear that names will not be sent for any competition where there is more than one person until all names are received but I give a maximum of three weeks for a person to contact me.

If that's what you have stated, don't think there is anything she can do, she'll just have to wait same as the others. I wouldn't worry about it, she's just being a pain in the bum :D

She cant I contacted ASA and CAP this morning and they said that the site has done nothing wrong! Feel much better knowing that particularly as she was so arrogant!

Well after she sent me another rude one I suggested that if she was going to quote CAPS rules and regulations she actually go and read them first so that she was at least doing it right! As you can imagine she didnt like that and anyway..shes banned now :)

I would send her the prize, but make it so she has to pay for the postage, add a couple of bricks for good measure :D
