Hi,

I just wanted to check to see if anyone here specialises in or is good with employment law and contracts of employment as I have some queries to make regarding changing them during the course of employment.

Basicaly I am contracted to do some work and recently have been told that pay is changing from weekly to 2 weekly. I and others that I work with do not want this.

In my conformation letter which I signed pay was agreed at weekly frequency.

I think im in the right to say that they are breaching the contract by changing it to 2 weekly but just wanted to get some legal advise first.

Hi Chris,

If you phone ACAS up, they're easy to find on the web. They will tell you if this can be done. Not personally come across this problem, we have never changed our payment method for staff.

We specialise in employment law.

Basically, an employer can change a fundamental term by giving 4-weeks written notice of any change. I cannot see how this change will adversely affect the employees especially when the employer would be entitled to change the way it operates, giving the required notice, in order to reduce its administration costs.

Solution:
I would suggest that an employer can change your terms and conditions if they give you full notice, which I think is about 4 weeks, and unless this is detrimental and adversely affects employees then they will probably be able to do this. However you could always explain to your employer why you would prefer to keep getting paid on a weekly basis. I would always suggest though that you get legal advice from somewhere so check what your rights are on this matter. Well having taken five years to find the thread, their speed of response presumably isn't one of their usp's :rolleyes:
