My logo is very similar to the logo used bu Fox Racing

I am sure I had the logo first - what should I do?

Even if you had it before them, it may just be a case of whos got the bigger budget to spend on legal action.
Ive known many people to be crushed like this, most of the time theres nothing you can do about it.
Sorry to be so pessimistic.

Their is no conflict here. The logos don't look the same at all.
Besides, you are a webhost - they are in off-road sportswear. Neither of you are trying to 'pass-off' as each other and you are both in entirely different trade mark 'classes'.
Move on. :)

I doubt it.
I used to do moto cross with the YMSA back in the late seventies, we all used to wear Fox gear back then.
The company with it's fox head logo was formed back in 1974.

Eagle is basically right, but you need to be careful not to confuse trade marks and copyright - the first protects against confusing similarity regardless of intent (so trade mark rights are always related to a business but innocence is no defence), whereas copyright depends on whether copying has taken place regardless of what the copy is applied to (so two people can take separate photographs of the same view and not infringe even if they look identical, but you can't copy Eagle's logo on a label for any product whatsoever).
You can get both trade mark rights and copyright in a logo, but only trade mark rights in name.
