i had a developer building me a system. Initially on the contract we agreed 4 payments at the end of each phase. We then via email agreed to spread the payments over 18 monthly payments including one downpayment/desposit.
Me and the developer have fallen out big time. He has not delivered as agreed on the contract. the whole project is 3 months overdue, phase 1 is 5 months overdue. he has stated in a couple of emails he does not want to continue will i still have to pay him?

Why would you have to pay him if he has breached contract?

im concerned that he may say that i have to pay for the work he has carried out. unless its a complete system its not of any help to me

Be careful this doesn't go further than it should !

Recheck the contract, get sound legal advice and act accordingly. Without seeing what was originally 'agreed' and written, I cannot tell you yea or nay.

You should be able to get something free via CAB, but otherwise, try to find a forum that has hosted similar questions thus giving you a more specific answer.
