hello

i received a late fine of £100 for not sedning in a tax return form. the fine was for a partnership im not even a partner of ?

i think it was to do with when i rang up to enquire about working as self employed several years ago but i rang to resolve the issue a logntime ago (we had to send in all sorts of information because i had been signed up as self emplyed without my consent)

now i ring and they say im still part of a partnership and have to pay the fine

its ludicrus

any advice on what to do it ? seems the appealing 30 days has run out should i still appeal it and send in tax forms or write a letter of compalint ?

im confused

A fine for a late partnership return can only be imposed on people who were members of the partnership for the tax year in question. If you weren't a partner at any time in the year, then the fine shouldn't stick.

I've used this argument successfully where a former partners were sent penalty notices for the year after cessation. Neither were partners in the relevant tax year, therefore neither can possibly be pensalised! :)

and further down in the section on the fine states the name of the supposed partnership im in.

Yes.

It's not clear if you ever were a partner, but resigned before the tax year in question. If you were, tell them the date that you left.

If you've never been a member of the partnership, tell them that.

Make it clear in the letter that you are appealing the penalty on the grounds set out.
